The 2023 Social Democratic Party (SDP) governorship candidate in Adamawa State, Umar Ardo, has decided to withdraw his appeal against Governor Ahmadu Fintiri’s re-election at the Supreme Court.
Ardo had initially sought the nullification of Fintiri’s victory, citing substantial non-compliance with the Electoral Act, allegations of corrupt practices, threats, and violence during the electoral process.
Sylvester Imanobe, the counsel for the SDP, revealed that the party had secured 6,000 votes in the election. However, the court emphasized the distinction between the integrity of the election and numerical strength. Recognizing the court’s mood, Ardo and the SDP chose to withdraw the appeal.
In November, the Court of Appeal in Abuja had already dismissed Ardo’s petition challenging Fintiri’s victory in the 2023 polls. Justice Ugochukwu Ogakwu, delivering the ruling, upheld the previous decision of the Tribunal, led by Justice Theodora Uloho, which had deemed Ardo’s petition incompetent and improperly filed.
The appellate court maintained that the appellants failed to substantiate allegations of corrupt practices and non-compliance with the Electoral Act against the Independent National Electoral Commission (INEC). Justice Ogakwu concluded that there was no basis to grant the appeal.
Following Fintiri’s declaration as the winner of the poll, Ardo and the SDP had initially filed a petition at the State Governorship Election Tribunal, reiterating claims of substantial non-compliance, corrupt practices, threats, and violence during the electoral process. Despite an appeal to the Supreme Court, Ardo eventually withdrew the appeal against the governor.
