Appeal Court Annuls Election of LP’s Denis Agbo in Enugu

The Court of Appeal in Lagos State has invalidated the election of Denis Agbo, a representative of the Labour Party. Agbo, who was serving the Udenu/Igboeze North federal constituency in Enugu State, has been directed to vacate his position, with a re-election scheduled within the next 90 days.

The judgment was delivered on Friday via a virtual court session. The appeal was initiated by Dr. Oby Ajih, the candidate from the All Progressives Congress who had contested the previous election. Ajih had disputed the tribunal’s decision, alleging that the election was flawed due to the omission of her party’s logo in the EC8A form.

In a swift judgment that spanned less than half an hour, the Court of Appeal concurred that the appeal was justified and consequently overturned the tribunal’s decision. The court declared that the exclusion of the APC’s logo in the result sheet (form EC8A) constituted a breach of the electoral act. Consequently, the Independent National Electoral Commission (INEC) has been instructed to orchestrate a fresh election within the stipulated period.

This pivotal ruling is poised to reshape the political dynamics in the Udenu/Igboeze North federal constituency of Enugu State.
