Appeal Court Dismisses Enugu Rep, Declares Labour Party Candidate as Winner

The Court of Appeal sitting in Enugu has upheld the sack of Hon. Simon Atigwe of the Peoples Democratic Party (PDP) from the House of Representatives, confirming Hon. Dennis Nnamdi Agbo of the Labour Party (LP) as the rightful winner of the February 3, 2024, re-run election for the Igbo-Eze North/Udenu Federal Constituency.

The judgment, delivered by a three-member panel led by Justice J.O. Ekanem, affirmed the earlier decision of the Election Petition Tribunal, which ruled in favor of Agbo. The court’s decision was unanimous.

Ifeanyi Ogenyi, a lawyer representing the Labour Party, shared the news in a post, celebrating the outcome, saying,“Congratulations to the people of Igbo Eze North/Udenu Federal constituency,” he added.

“The wheel of justice turns slowly, but it grinds. Truth and justice have prevailed. Dennis Agbo has prevailed!”

The Independent National Electoral Commission (INEC) had initially declared Atigwe the winner of the re-run election, despite Agbo’s previous victory in the February 25, 2023, general election, which was later nullified by the appellate court.

Agbo proceeded to the tribunal to challenge Atigwe’s victory and won both at the tribunal and now at the Appeal Court.
