Court Restrains PDP from Removing Senator Anyanwu as National Secretary

The Federal High Court in Abuja has issued an order preventing the Peoples Democratic Party (PDP) from removing Senator Samuel Anyanwu as the national secretary until the substantive matter is heard and decided.

The ruling comes as a response to an ex-parte request filed by Joshua Musa, SAN, and was granted by Justice Inyang Ekwo on Thursday.

The case, which has been adjourned until December 4, stems from a lawsuit filed by two party members, Geoffrey Ihentuge and Apollo’s Godspower, against the PDP, Umar Aliyu Damagun (acting National Chairman), and the National Executive Committee (NEC) as the first to third defendants.

The National Working Committee (NWC) and the Independent National Electoral Commission (INEC) are also named as the fourth and fifth defendants, respectively.

The plaintiffs sought an interim injunction, invoking Order 26, Rules 2 and 6 of the FHC (Civil Procedure) Rules, 2019, along with the court’s inherent authority.

The injunction aims to restrain the first, second, third, and fourth defendants from removing Senator Anyanwu as the national secretary.

According to the plaintiffs, such an action would violate Article 47 (1) of the PDP Constitution (revised in 2017) pending the hearing and determination of the move on notice.
